These Terms of Service ("Terms") govern your use of All Pathways (ABN 68 108 607 420) ("All Pathways", "we", "us", "our") and our website and platform at www.allpathways.com.au (the "Service"). By creating an account or using the Service, you agree to these Terms. Please read them together with our Privacy Policy and Refund & Billing Policy.
1. About All Pathways and our role
All Pathways is a third-party education-services provider. We give you an online platform and support to gather and complete the evidence required for a nationally recognised qualification. We are not a Registered Training Organisation (RTO). The formal assessment of your evidence, the competency decision, and the issuance of any qualification or statement of attainment are carried out by our partner RTO under a written agreement. In these Terms, "the partner RTO" means that organisation.
2. Eligibility and your account
- You must be at least 18 years old and able to enter a binding contract.
- You must give accurate, current and complete information — including a valid Unique Student Identifier (USI) where required — and keep it up to date.
- Your account is personal to you. Keep your password secure and don't share your account. You're responsible for activity under it.
- We may decline, suspend or close accounts that contain false information or breach these Terms.
3. What the Service does — and doesn't do
- The Service helps you assemble evidence — knowledge answers, work history, photos and video of your work, and a supervisor sign-off — and submit it for assessment by the partner RTO.
- Getting started does not guarantee a qualification. Whether you are assessed as competent depends on you meeting the requirements of the relevant unit(s) of competency, as determined by the partner RTO. We do not make competency decisions.
- We provide the tools, structure and support. We don't guarantee any particular result, licence, or employment outcome.
4. Fees, billing and the submission fee
- Subscription: the Service is $20 per week (AUD), billed weekly in advance to your nominated payment method through our payment processor (Stripe), and recurs automatically until you cancel.
- One-off submission fee: a one-off fee of $500 (AUD) applies when your evidence is complete and you are ready to submit it to the partner RTO for formal assessment and issuance. You are only charged this when you reach that point, and we will tell you when you do. Until then, you only pay the weekly subscription.
- All fees are in Australian dollars and are inclusive of GST.
- You authorise us and Stripe to charge your payment method for these fees. If a payment fails, we may pause your access until it is resolved.
- We may change our fees with reasonable notice. Changes won't affect fees already charged.
5. Cancellation
- You can cancel your subscription at any time from your account settings — it takes one click.
- Cancelling stops future weekly charges. You keep access until the end of the week you've already paid for.
- Refunds, including our early-refund safety net, are set out in our Refund & Billing Policy.
6. Your evidence and authenticity
- The evidence you provide must be true, genuine and your own work. Submitting false, misleading, plagiarised or fraudulent evidence is a serious breach and may result in immediate termination, and the partner RTO may decline or revoke any assessment outcome.
- You confirm you have the right to provide the photos, video, documents and third-party (supervisor) details you upload, and that any such third party has agreed to take part.
7. Your content and our content
- You keep ownership of the evidence and materials you upload. You grant us and the partner RTO a licence to store, use, reproduce and share that material as needed to provide the Service, assess your evidence, issue any qualification, and meet our legal and compliance obligations.
- All Pathways' platform, content, learning materials, branding and software are owned by us or our licensors. You may use them only as part of the Service, and must not copy, resell or redistribute them.
8. Acceptable use
You agree not to: misuse or interfere with the Service; try to access it unlawfully or gain unauthorised access; share your account; submit fraudulent evidence; or use the Service for anything unlawful.
9. The partner RTO
Formal assessment, the competency decision and certificate issuance are performed by the partner RTO in accordance with the Standards for RTOs and the relevant training package. The partner RTO's own policies apply to that assessment and issuance. We are not responsible for the partner RTO's assessment decisions.
10. Privacy
We handle your personal information in line with our Privacy Policy. By using the Service you consent to that handling, including sharing your evidence with the partner RTO for assessment and issuance.
11. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
12. Liability
To the extent permitted by law, and subject to the Australian Consumer Law:
- the Service is provided on an "as is" basis and we don't guarantee it will be uninterrupted or error-free;
- we are not liable for any indirect, special or consequential loss; and
- where our liability can be limited, it is limited (at our option) to re-supplying the Service, paying the cost of re-supply, or refunding the fees you paid in the three months before the claim.
13. Suspension and termination
We may suspend or close your account if you breach these Terms (including for fraudulent evidence or non-payment). You can stop using the Service at any time by cancelling.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll let you know — for example by email or a notice on the site. Continuing to use the Service after the changes take effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of Queensland, Australia, and you submit to the courts of that State.
